Probate Court Guardian ad Litem Project

Trained volunteers working under the direction of the local Probate Judge will interview and visit with guardians and wards. They will make detailed reports and recommendations so the Court can make more informed decisions.

Training: Application and criminal record check; 10 hours of training and observation of a guardianship hearing

 

Purpose of pro bono opportunity

  1. To provide opportunities for law students to work along side the attorneys and clients in the probate court system in SC
  2. To provide skills development and enhancement opportunities for law students
  3. To create an awareness of the problems and rewards faced by the public regarding guardianship
  4. To observe the SC court system in action
  5. To assist the probate judges in making decisions regarding incapacitated individuals and guardianships

Requirements or qualifications

Law students must:

  1. be a good academic standing
  2. complete and submit the Volunteer Enrollment Form
  3. have completed 12 hours of training; attending a hearing and participated in one visit with an experienced volunteer
  4. have an interest in serving the indigent and vulnerable population

Responsibilities of organizations

The Probate Court must:

  1. agree to properly supervise the work of the law student
  2. provide clear and timely instructions
  3. seek opportunities to expose the students to various tasks
  4. provide feedback when possible.
  5. Communicate with the students about available hearings and cases.

Responsibilities of the students

The students must:

  1. communicate effectively and efficiently with the Probate Court staff
  2. complete tasks in a timely and competent manner
  3. seek assistance when needed
  4. perform duties professionally
  5. treat this volunteer opportunity as if it was a paying or for-credit position
  6. coordinate with other similar situated volunteers to work in teams of two
